End User License Agreement

This End User License Agreement (the "License") is between you and the operator of Ruckwise ("we", "us"). It covers the Ruckwise app for iPhone, iPad and Apple Watch, its widgets, and any updates (together, the "App"). Our Terms of Use and Privacy Policy also apply and are part of this License. If you don't agree, don't download or use the App.

1. Who this agreement is with

This License is between you and us only, not with Apple Inc. We, not Apple, are solely responsible for the App and its content. If this License conflicts with the Apple Media Services Terms and Conditions (the "Usage Rules"), the Usage Rules control where they give you more protection.

2. Your license

We give you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, as allowed by the Usage Rules. That includes other accounts in your Apple Family Sharing group, if the App is offered through Family Sharing. The license is for your personal, non-commercial use.

4. Ownership

The App is licensed, not sold. We and our licensors keep all rights, title and interest in the App, including its code, design, and the Ruckwise name and logos. Bank and merchant names and logos shown in the App belong to their owners and are shown only to help you recognize your accounts. Their appearance doesn't mean those companies endorse Ruckwise.

5. Your data

You own the financial information you add to or connect with the App. Most of it is stored on your device. If you create an optional account, it is stored as described in our Privacy Policy. You can export it or delete it at any time.

6. Not financial advice

The App helps you organize and plan your money. Its numbers, including budgets, safe-to-spend, debt payoff plans, net worth, TSP illustrations, military pay and VA benefit estimates, and assistant answers, are estimates and general information, not financial, investment, tax or legal advice. They may be wrong or out of date. Confirm important decisions with official sources (such as your LES, DFAS, the VA, or your installation's Personal Financial Counselor) or a qualified professional. Ruckwise is not affiliated with or endorsed by the U.S. Department of Defense, the Department of Veterans Affairs, or any branch of the armed forces.

7. The assistant (Ask Ruckwise)

The assistant runs on your device using Apple's on-device model, and it may look up public information on the web when you ask a general question. Its answers can be incomplete or wrong. Don't rely on them alone for important decisions. Don't enter other people's sensitive information into it.

8. Bank connections and third-party services

Bank connections are provided by Plaid Inc. and are subject to Plaid's terms. Your bank's records are the official record of your balances and transactions. Some features depend on third parties (such as Apple, Plaid, and web services). We aren't responsible for their content, availability or terms. You must also follow any third-party terms that apply when you use the App, such as your wireless carrier's data plan.

9. Parent mode and kid profiles

Ruckwise accounts are for adults 18 and older. A parent or guardian may create kid profiles and set up a child's device in parent mode. The parent is responsible for the child's use and agrees to this License on the child's behalf.

10. Beta versions

Test versions offered through TestFlight may have bugs, may change or stop working, and may lose data. Use them at your own risk, and keep your own records. Apple's TestFlight terms also apply.

11. Feedback

If you send us ideas, survey answers or feedback, we may use them to improve Ruckwise without owing you anything. We won't publish your name with them without your permission.

12. Updates and changes

We may release updates that add, change or remove features. Some updates may be required to keep using the App. If we change this License in a material way, we will tell you in the App before the change takes effect.

13. Maintenance and support

We are solely responsible for any maintenance and support for the App, as described in this License or required by law. Apple has no obligation to provide any maintenance or support for the App. For help, contact us at support@ruckwise.com or use Help in the App.

14. Warranty

To the fullest extent allowed by law, the App is provided "as is" and "as available", without warranties of any kind, including accuracy, merchantability, fitness for a particular purpose, and non-infringement. If the App fails to conform to any warranty that the law requires despite this disclaimer, you may notify Apple, and Apple will refund the purchase price for the App, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the App. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility, to the extent the law doesn't let us disclaim them.

15. Product claims

We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your possession or use of it. That includes (a) product liability claims; (b) claims that the App fails to meet a legal or regulatory requirement; and (c) claims under consumer protection, privacy or similar laws, including in connection with the App's use of HealthKit or HomeKit, if the App ever uses them.

16. Intellectual property claims

If a third party claims that the App, or your possession and use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.

17. Limitation of liability

To the fullest extent allowed by law, we won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or opportunities, arising from the App. Our total liability for any claim relating to the App is limited to the greater of the amount you paid us in the 12 months before the claim or $50. Some places don't allow these limits, so they may not apply to you.

18. Legal compliance

You represent that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to follow U.S. export laws when using the App.

19. Ending this License

This License lasts until you or we end it. You can end it by deleting the App and, if you have one, your account. We may end it if you break this License. When it ends, you must stop using the App. Sections 4, 6, 11 and 14–22 continue after it ends.

20. U.S. Government end users

The App is a "commercial item" made up of "commercial computer software" and "commercial computer software documentation," as those terms are used in 48 C.F.R. §2.101, 12.212 and 227.7202. It is licensed to U.S. Government end users only as a commercial item, with only the rights granted to all other users under this License.

21. Governing law and disputes

This License is governed by the laws of the State of Maryland, without regard to conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve it informally within 30 days. Either of us may bring a claim in small claims court. Otherwise, claims will be heard in the state or federal courts located in Maryland. Nothing in this License limits rights you have under the Servicemembers Civil Relief Act or other laws that can't be waived.

22. Apple is a third-party beneficiary

You and we agree that Apple and Apple's subsidiaries are third-party beneficiaries of this License. Once you accept this License, Apple has the right, and is deemed to have accepted the right, to enforce this License against you as a third-party beneficiary.

23. General

If any part of this License is found unenforceable, the rest stays in effect. If we don't enforce a part right away, we haven't waived it. You may not transfer this License without our consent. We may transfer it as part of a merger, acquisition or sale of assets. This License, with the Terms of Use and Privacy Policy, is the entire agreement about the App.
